Plain-English framing: under the Clean Air Act, a 'major source' of air pollution (which any data center with significant backup-generator capacity is) cannot start physical construction until its air permit is issued. The permit specifies what control technology must be installed. Two things changed this month that pull in opposite directions. Virginia's piece is the tightening side. Tier 4 is the highest EPA tier for non-road diesel engines and requires advanced exhaust aftertreatment (SCR + DPF + DOC). Pre-Tier 4, most data-center backup diesels were Tier 2. The cost delta per generator is real — roughly $50-150k of incremental hardware per unit plus higher operating cost (urea / DEF for SCR). A 100 MW campus with 30 backup gen-sets is looking at a low-millions CapEx delta. The presumptive 0.60 g/hp-hr NOx limit is what locks it: 'presumptive' means a permit applicant has to affirmatively prove a less-stringent alternative is acceptable, which raises the cost of even arguing for older units. HB 507 codified DEQ's authority to go even tighter. EPA's piece is the loosening side. 'Begin Actual Construction' currently means once you cross a definitional threshold (foundation work, building anchored equipment) you have triggered the prohibition — you can't lay concrete until the permit is in hand. Permit timelines in active states are 12-24 months. Letting construction start in parallel with permit review collapses a major part of that schedule. The proposed rule is in comment period now and will not be final by July, but the direction is set. The Virginia July 1 deadline creates a hard product opportunity in the next five weeks: any developer with a Virginia site that has not yet filed its air-permit application has a structural reason to file BEFORE July 1 to lock in pre-Tier 4 BACT, and a structural reason to delay if their equipment selection isn't ready. Cliff's site-readiness view of every Virginia parcel in the diligence pipeline should show a countdown to July 1 and a flag for 'filed / not filed.' This is the cleanest possible application of the live-docket wedge — a specific permitting authority, a specific deadline, a specific change in standard. The federal EPA proposal is medium-term context: it will not be final this summer, but it confirms that the federal direction (DOE pushing FERC to accelerate large-load interconnection, EPA loosening preconstruction) is consistently pro-build, while state air agencies are tightening. Map this as a deliberate jurisdictional split in the underwriting tool — a Virginia site is now subject to two opposite-direction regulatory vectors at once, and the EPA layer doesn't help if the state DEQ is the binding agency on backup-diesel BACT (it usually is).
